Currently, a large percentage of companies have a symbol that distinguishes them in the market, either for their products or their services. This distinctive symbol is known as a BRAND. Below, we will look at the main aspects to consider when creating our brand:

  1. Select the brand. When selecting our brand, there are two basic aspects to take into account from a commercial point of view, so that it can be more successful: simple pronunciation and easy memorization. It is advisable to check that the brand you intend to register is not registered by another person or entity.

  1. Types of marks. Any sign can constitute a mark, especially: words, drawings, letters, figures, colors, sounds, or the shape of the product and its packaging.

  1. Who can request it? Any natural or legal person, directly or through an authorized representative.

  1. Scope of protection. Industrial registrations are territorial, that is, registering a brand in Spain confers on its owner exclusive use in Spain. There is the possibility of extending protection to a community or international level, although the costs of such a procedure increase.

  1. Where to submit the application? Through the electronic headquarters of the Spanish Patent and Trademark Office (OEPM). Also in person at the Spanish Patent and Trademark Office, Regional Industrial Property Centers, or through Post Offices.

  1. How much does it cost to register a Trademark in Spain?  At the date of publication of this article, to register a trademark through the Spanish Patent and Trademark Office web platform, fees of €125.36 must be paid.

  1. Procedure and duration. The application procedure lasts approximately between 6 and 12 months. If accepted, ten years after the application, renewal must be requested for another ten years to keep it in force.

  1. Documentation for registration: To register a trademark, the following documentation will be requested:

  • Name and surname (natural person), corporate name (legal person).
  • DNI/NIE/CIF (ID/Tax ID).
  • Percentage of participation in the rights of said trademark for each participant.
  • Nationality, State of residence, and State of establishment.
  • Address, email, and phone number.
  • Indicate the products and/or services for which the trademark is requested.
  • Image of the logo in black and white, .jpg format, and resolution 1216x840.

Registering your company's trademark is a vital procedure, since the brand is the image of your company, and if someone gets ahead in its registration, it will entail a very high cost, as you will lose the brand image progress accumulated up to that moment.
